Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement
This Release of Liability and Waiver ("Agreement") is entered into by the undersigned ("Participant") in favor of Tom Randt and/or Lisa Czarkowski, owners and/or affiliates of Whiteduck Mountain Kennel and Whitewind Labradors located at 355 Creamery Rd., Greenfield Township, PA 18407 (the "Property").
Assumption of Risk
The Participant acknowledges and agrees that entry onto the Property, including any surrounding land, buildings, structures, kennels, and outdoor areas, involves inherent risks, including but not limited to the risk of slipping, tripping, or falling due to uneven terrain, weather conditions, or natural features. Additionally, the presence of dogs on the premises may present a risk of injury, including the risk of dog bites or other animal-related incidents.
By signing below, the Participant voluntarily assumes all such risks, whether anticipated or unanticipated, and whether caused by the negligence of the owners or otherwise.
Release and Waiver
In consideration for being permitted to enter and/or use the Property, the Participant hereby releases, waives, and discharges Tom Randt and/or Lisa Czarkowski, their heirs, successors, assigns, agents, employees, and affiliates (collectively, the “Released Parties”) from any and all liability for any loss, damage, injury, or death to persons or property, including but not limited to those arising from slip and fall incidents or dog bites, whether caused by the negligence of the Released Parties or otherwise.
Indemnification
The Participant agrees to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, damages, costs, or expenses (including attorney’s fees) arising out of or in connection with the Participant’s presence on the Property or any actions of the Participant or any guest or pet brought onto the Property by the Participant.
Acknowledgment
The Participant acknowledges that they have read and understood this Agreement, and that they are signing it voluntarily and with full knowledge of its legal consequences. This Agreement shall be binding upon the Participant and their heirs, executors, administrators, and assigns.
